These Terms of Service ("Terms") govern your use of Gamma Trade (the "Service"). By creating an account or otherwise using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract in your jurisdiction.
2. Accounts
- You are responsible for safeguarding your account credentials.
- You must notify us immediately at support@gextrade.fyi of any unauthorized access.
- One person or entity per account; you may not share credentials.
3. Subscription Plans
Gamma Trade offers free and paid tiers. Paid plans (currently Pro at $19.95/month) are billed in advance via Stripe. Subscriptions renew automatically; you can cancel anytime from the Billing page. Refunds are pro-rated only where required by law.
4. Acceptable Use
- Don't reverse engineer, scrape at abusive rates, or attempt to access non-public APIs.
- Don't probe for vulnerabilities outside our Vulnerability Disclosure Policy.
- Don't redistribute market data in violation of source-exchange terms.
- Don't use the Service to harass, defraud, or harm others.
5. Not Investment Advice
Gamma Trade is an analytics and educational tool, not a broker-dealer or registered investment adviser. Nothing in the Service constitutes investment, tax, or legal advice. Markets data may be delayed, inaccurate, or incomplete. You are solely responsible for your trading decisions.
6. Third-Party Integrations
Optional integrations (Plaid, Stripe, brokerage links) are governed by the third party's own terms and privacy policies. We are not responsible for third-party services.
7. Intellectual Property
The Service — including code, UI, analytics, and content — is owned by Gamma Trade and protected by IP laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
8. User Content
You retain ownership of content you create (saved analyses, notes, watchlists). You grant Gamma Trade a worldwide, royalty-free license to host, process, and display that content as needed to operate the Service.
9. Termination
We may suspend or terminate your account for material violation of these Terms. You may close your account at any time. Upon termination, your data is handled per our Data Retention & Deletion Policy.
10. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GAMMA TRADE'S AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA.
12. Indemnification
You agree to defend and indemnify Gamma Trade against claims arising from your use of the Service or your violation of these Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.
14. Changes to these Terms
We may update these Terms periodically. For material changes we'll notify you at least 14 days in advance by email or in-app banner. Continued use after the effective date constitutes acceptance.
